POLICIES, REGULATIONS, TERMS & CONDITIONS
THANK YOU FOR SELECTING TO STAY WITH DUNE ALLEN REALTY FOR YOUR UPCOMING BEACH VACATION. BECAUSE SOME PROPERTIES REQUIRE A MINIMUM STAY OR HAVE SPECIFIC TURN-DATES, YOUR RESERVATION WILL BE HELD, BUT YOUR CREDIT CARD WILL NOT BE CHARGED UNTIL DUNE ALLEN REALTY CONFIRMS YOUR RESERVATION EITHER BY PHONE OR BY CONFIRMATION EMAIL.

Dune Allen Realty serves as the agent for the owner of the rental property. Dune Allen Realty properties are family vacation rentals and property owners set maximum limits on the number of people their respective properties may accommodate. The rental property may not be sublet and your reservation may not be transferred to another party at any time.

Age Requirements:

You must be age 25 or older to make a reservation. There must be one (1) adult age 25 or older per three (3) people under the age of 25 staying in the unit at all times. Dune Allen Realty reserves the right to make property inspections and request ID for verification purposes. As per Florida State Statute 509.141, reservations made under false pretense are null and void and check-in will not be allowed, or guests must vacate property immediately. Guests who violate this policy are subject to forfeiture of all rental payments.

Reservation Payments / Service Fee:

Your reservation requires a first payment of 50% percent upon booking and a final payment of 50% thirty days prior to your arrival. A service fee will be added to your reservation. This non-refundable service fee includes housekeeping, an accidental damage fee for accidental damages up to $1,000 (see details under “Damages” heading below) and processing your reservation. Please note that the service fee amount varies upon property. We accept Mastercard, Visa, e-checks, and personal checks with proper ID. All account information is encrypted and secured for your protection.

A travel protection policy (see details under “Travel Protection Insurance” policy below) is optional, but strongly recommended (see Cancellation policy below).

Travel Protection Insurance:

Dune Allen Realty has partnered with Red Sky Travel Insurance to provide Sun Trip Preserver® coverage for our guests. Sun Trip Preserver provides cancellation and interruption services as well as emergency assistance and travel services. The travel insurance is optional, but strongly recommended. The cost is 6.95% of your total reservation stay. The insurance premium is non-refundable and non-transferable. Other than as provided in our Cancellation policy (see Cancellation policy below), please understand that refunds are only available through Sun Trip Preserver coverage provided by Red Sky Travel Insurance, and at no time will refunds be issued by Dune Allen Realty for any reason, including, but not limited to, a Mandatory Evacuation or beach closure due to actual or anticipated hurricanes, tropical storms or other inclement weather, a declaration of emergency or natural disaster, issuance of Executive Orders from the Governor of Florida or any local or federal government mandates or ordinances issued during a declared emergency and/or disaster, or any closure or ban on beaches or vacation rentals. To learn more about Sun Trip Preserver or to file a claim, please visit www.SunTripPreserver.com. Taxes:

Your reservation and the non-refundable service fee are subject to Florida state and local sales taxes. Taxes are subject to change and can be reassessed prior to your stay.

Damages:

For the registered guest of a Dune Allen Realty Vacation Rental, the Accidental Damage Fee pays up to $1,000.00 for accidental damages that might occur to the rental unit or its contents during your stay, provided that any accidental damages are immediately disclosed to Dune Allen Realty’s management staff. The Accidental Damage Fee does not pay for damages resulting from smoking, pets, willful misconduct, or gross negligence. The Accidental Damage Fee does not pay for theft of any items belonging to the rental unit or theft or damage of any property owned by or brought into the unit by the guests of that rental unit. The Accidental Damage Fee does not pay if damages are not reported promptly to Dune Allen Realty. A credit card number will be held and the credit card charged should any accidental damages occur which exceed $1,000.00. Any damages that might occur that are not paid under the Accidental Damage Fee guidelines of Dune Allen Realty will be charged to the credit card on file for your stay. Dune Allen Realty will make a complete inspection of the property before your arrival and after your departure. We ask all guests to treat their rental property with good care.

Cancellation:

In the event you must cancel your reservation, please contact our office as soon as possible. If you choose to decline Red Sky Travel Insurance, Dune Allen Realty has no obligation to refund your rental payments.  However, Dune Allen Realty will refund your rental payments, less a $200 Cancellation Fee and the non-refundable Service Fee, if the property is re-rented for the same time period and at the same rate. If the property is re-rented at a lesser rate during the same time period, the $200.00 Cancellation Fee, the non-refundable Service Fee plus the difference in rental rate will be deducted from your refund. If the property cannot be re-rented during the same time period, there will be no refund issued by Dune Allen Realty.

Other than as provided in the above paragraph,no refunds will be issued for any reason by Dune Allen Realty including, but not limited to, a Mandatory Evacuation or beach closure due to actual or anticipated hurricanes, tropical storms or other inclement weather, a declaration of emergency or natural disaster, issuance of Executive Orders from the Governor of Florida or any local or federal government mandates or ordinances issued during a declared emergency and/or disaster, or any closure or ban on beaches or vacation rentals. To protect your vacation and prevent loss of rental payments, we strongly recommend purchasing Red Sky Travel Insurance or any travel insurance policy of your preference as such coverage may provide insurance for loss of rental payments.

Off-Season Guests:

Off-Season guests are required to pay the balance due of the first month’s rent 30 days prior to arrival. Each additional month must be paid in full 30 days prior to the upcoming month.

Reservation Changes:

A $200 fee will be charged for any change of date made to a reservation after the reservation has been confirmed. A change of date will only be allowed up to 60 days prior to arrival date and the new stay must take place within the same calendar year of the original arrival date. At no time will a change of date result in a lower rate. At no time will a change of date result in a refund of rental payments.

Unavailability of Accommodation:

In rare cases beyond our control, some vacation rentals may become suddenly unavailable due to unforeseen circumstances, i.e. residence sold, removal from our rental program, owner usage, mechanical failures. If so, and in the case of a confirmed reservation with deposit, you will be notified immediately. Be assured that we will make every effort to substitute a comparable or upgraded property if an equivalently priced property is unavailable for your same stay date, or the same property for a later date of your choosing. At no time will the unavailability of a property result in a refund of rental payments.

Severe Weather:

At no time will Dune Allen Realty issue refunds or partial refunds for Mandatory Evacuations, cancellations or shortened stays due to actual or anticipated hurricanes, tropical storms or other inclement weather. Please see Travel Protection Insurance section above.  Refunds or partial refunds for Mandatory Tropical Storm or Hurricane Evacuations are only available to guests covered by the Sun Trip Preserver coverage provided by Red Sky Travel Insurance. The coverage must have been purchased before the storm was named.

Check-In:

Check-in begins after 4:00 p.m. CST and can be as late as 7:00 p.m. CST. If unit is delayed due to unavoidable circumstances, there will be no discount given due to a later than normal check-in. Your check-in information will be provided to you through Glad To Have You and Escapia via e-mail on the day of your arrival and once your vacation property is ready.

Check-Out:

Check-out time is by 9:00 a.m. CST. Late check-out may be available for an additional fee. All keys must be left at your vacation property upon check-out. We request that you leave one key in the lock box at the property and the remaining keys on the counter before you leave.  A lock box is also available at Dune Allen Realty.

Construction:

Dune Allen Realty and its vacation property owners can neither predict nor control house or road construction work in the South Walton area and therefore cannot be held responsible for any inconvenience due to nearby construction. If your vacation home is near an ongoing construction site, and you experience a problem, please let us know and we will ask the contractors to be extra considerate. Unfortunately, Dune Allen Realty cannot offer refunds or accommodation moves due to construction noise.

Unforeseen Repairs:

Dune Allen Realty makes every effort to make sure your vacation is completely hassle free by keeping each vacation property and its mechanical equipment in top condition. However, we cannot predict when a problem might occur. Should you experience a problem, we will make repairs as soon as possible. No refunds or rate adjustment will be provided at any time for mechanical failures (air conditioning, heating, television, internet, kitchen appliances, power outages, elevators), pest intrusion, weather conditions, or any condition beyond Dune Allen Realty’s or its vacation property owners’ control.

Pets:

We have several pet-friendly properties. A maximum of two trained pets are permitted in the pet friendly properties. Some pet-friendly properties have maximum weight and breed requirements—please contact Dune Allen Realty regarding your pet. Upon management’s approval, a $200 non-refundable pet fee will be required for pet stays, with an additional $100 for a second pet. Pet owners will be held financially responsible for any damage or additional cleaning that may be necessary due to pets. Guests who violate this policy will be immediately evicted with forfeiture of all payments received. Please note, dogs are not allowed on the beaches without a special permit from Walton County.

Dune Allen Realty is dedicated to providing reasonable accommodation to protect the rights of guests with disabilities to bring a service animal or emotional support animal under the terms of the Fair Housing Amendments Act of 1988, Section 504 of the Rehabilitation Act of 1973, and Title II of the Americans with Disabilities Act. Should a guest require a service animal or emotional support animal (as described under the above Acts), the guest should contact Dune Allen Realty to request reasonable accommodation for their needs. At no time does a guest need to disclose the details of their disability, nor provide any medical history.

Emergencies:

In case of an emergency, please call 911. Dune Allen Realty offers a 24-hour on call service for non-medical, non-hazard assistance.

Indemnification:

Renter hereby agrees to indemnify, defend, and hold harmless Dune Allen Realty, and its members, agents, employees and assigns, and the homeowner, from and against any claims or suits made or filed or judgments entered which arise from or are in any way related to the use of the rental property, breach of the Rental Agreement or Rental Policies or as a result of the negligent or intentional acts of Renter, including, but not limited to, the costs and reasonable attorney’s fees expended in defense of such claim.

Venue, Jurisdiction, and Attorney’s Fees

The exclusive venue for any civil action related to this Agreement or the course of dealings between the parties is the county and circuit Courts sitting in Walton County, Florida. The parties hereby submit to the personal jurisdiction of all the courts in the previous sentence and agree not to challenge such jurisdiction. In any action, suit, or proceeding to enforce or interpret the terms of the Agreement or to collect any amount due hereunder, the prevailing party shall be entitled to reimbursement for all costs and expenses reasonably incurred in enforcing, defending or interpreting its rights hereunder, including, but not limited to, all attorney’s fees and the costs expended in determining entitlement to an amount of such fees and any costs and attorney’s fees incurred in any appellate process.

Occupancy Rules and Regulations:

  • House parties, weddings and other large events are not permitted in any of our properties unless arranged in writing through Dune Allen Realty and applicable event fee is paid.
  • Furnishings must never be removed from the property for use outside or in other properties. Furniture must not be rearranged inside the property.
  • Most properties restrict parking for Campers, Boat Trailers or Motor Homes. If allowed, they must be parked in appointed areas and at no time may be hooked up or occupied while parked on property. Some properties (mainly condominiums, town homes) do not permit vehicles, other than those that belong to guests on their lots because of limited parking space. Please make arrangements with Dune Allen Realty should you plan to bring more than two vehicles.
  • Kindly extend consideration to other guests by maintaining reasonable noise levels and hours of activity.
  • Please leave the beaches the way you found them (please fill in sand after digging and pick up trash).
  • Fireworks are not permitted on the beach.
  • Beach towels are not provided. As no linens or towels are to be removed from the property, we ask that you bring your own beach towels.
  • Dune Allen Realty is not responsible for any acts of theft or vandalism, or any damages to any personal property owned by guest on the property during guest stay or personal items left by guest on the property after departure. We will make every reasonable effort to return left items to you.
  • Smoking or vaping is not permitted in any of our properties. Minimum charge for Ozone Treatment is $350.
  • To avoid additional cleaning charges, please be sure to take out all garbage and place all dirty dishes in dishwasher and turn on. Please be sure to return all keys to our office or drop box on departure. We charge $25.00 per key that is not returned.
  • Dune Allen Realty reserves the right to make inspections of rental properties at any time. If Dune Allen Realty determines that the Policies, Occupancy Rules and Regulations have been violated, guests will be immediately evicted with forfeiture of all payments received. For any repairs due to abuse or negligence of property, guests will be held responsible and their credit card on file will be charged accordingly.
